Gerber Scientific Licenses “Print to Cut Patent” Technology
to Graphtec Corporation
SOUTH WINDSOR, CT -
January 28, 2009 - Gerber Scientific, Inc. (NYSE: GRB), a worldwide leader in integrated automation solutions for the sign making, specialty graphics and other industries, announced today that it has granted a patent license to Graphtec Corporation, a leading global plotter and printer manufacturer. This license represents the third non-exclusive license Gerber has granted to a Japanese equipment manufacturer for its family of computerized “print to cut” technology patents, based off of its pioneering U.S. Patent 5,537,135. Financial and other terms of the license agreement were not disclosed.

Gerber is presently prosecuting an action for infringement of the ‘135 Patent in the Hartford, CT Federal District Court against Roland DGA Corporation, the distribution and sales arm of Roland DG Corporation of Hamamatsu, Japan. The Company is seeking damages and an injunction against Roland's sale of infringing products. The law suit is currently in the discovery phase, awaiting the setting of a trial date by the court.
